How to report material on a Berean site that you believe infringes your copyright, and how to respond if your material was removed.
1. Purpose
Berean respects the rights of authors and publishers. This page explains how Berean handles copyright complaints under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
2. Berean’s designated agent
- Name
- [Designated agent name, pending registration with the U.S. Copyright Office]
- Mailing address
- [Designated agent mailing address]
- Phone
- [Designated agent phone number]
- [Designated agent email address]
Until the agent is registered, send notices to info@bereaninstitutes.org with the subject “Copyright notice.”
3. What a notice must include
- Your physical or electronic signature, or that of a person allowed to act for the copyright owner.
- The copyrighted work you believe was infringed.
- The material you want removed, and where it is, such as its web address.
- Your name, mailing address, phone number, and email address.
- A statement that you believe in good faith that the use is not allowed by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or are allowed to act for the owner.
4. What happens next
- Berean reviews the notice. If it is complete, Berean removes the material or blocks access to it promptly.
- Berean tells the person who posted the material and sends them a copy of the notice.
- An incomplete notice may not be acted on. Berean will tell you what is missing if it can reach you.
5. If your material was removed: counter-notice
If you believe your material was removed by mistake, send the designated agent a counter-notice with:
- Your physical or electronic signature.
- The material that was removed and where it was before.
- A statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification.
- Your name, address, and phone number, and a statement that you agree to the jurisdiction of the federal district court for your address (or, outside the United States, any district where Berean may be found), and that you will accept service from the person who sent the notice.
Berean sends the counter-notice to the person who sent the original notice. Unless that person tells Berean within 10 business days that they have filed a court action, Berean restores the material in 10 to 14 business days.
6. Repeat infringers
Berean closes the accounts of people who repeatedly infringe copyright, when appropriate.
7. False claims
A person who knowingly makes a false claim in a notice or counter-notice may have to pay damages (17 U.S.C. § 512(f)). Before you send a notice, consider whether the use may be allowed, for example as fair use.
8. Library resources
The Open Reference Library holds public-domain and openly licensed works. If you believe a resource is labeled wrongly, tell us through the Contact page and include the resource title.
