Agreement to Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "your") and the Berean Institutes ("Institute," "we," "us," or "our") governing your access to and use of the website located at [bereaninstitute.org] (the "Site"), including all content, features, and services offered on or through the Site.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not use the Site.
Nature of the Institute
Berean Institutes is an independent academic institute. It is not a church, denomination, house of worship, or religious organization. The Institute does not conduct worship services, ordain clergy, issue doctrinal statements, or represent any denomination or faith tradition. All content provided through the Site is educational and scholarly in nature and does not constitute theological instruction, spiritual guidance, pastoral counseling, or religious advice.
Intellectual Property Rights
Unless otherwise indicated, the Site and all content — including but not limited to text, articles, graphics, logos, images, course materials, audio, video, and software — are the property of the Institute or its content suppliers and are protected by United States and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Site and its content for personal, non-commercial educational purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Site for commercial purposes without the prior written consent of the Institute.
User Accounts
Certain features of the Site require account registration. When creating an account, you agree to provide accurate, current, and complete information and to update that information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify the Institute immediately of any unauthorized use of your account. The Institute reserves the right to suspend or terminate accounts that violate these Terms.
Journal of Biblical Antiquity and Heritage
the Journal of Biblical Antiquity and Heritage is the Institute's peer-reviewed academic journal. Articles published in the Journal of Biblical Antiquity and Heritage represent the views, research, and conclusions of their individual authors and do not necessarily reflect the position of the Institute. Subscription terms, including pricing, access duration, and renewal, are governed by the terms presented at the time of subscription. The Institute reserves the right to modify subscription terms with reasonable notice.
Courses
Course enrollment, pricing, schedules, instructors, and availability are subject to change. The Institute reserves the right to modify course content, reschedule or cancel sessions, or discontinue courses with reasonable notice. Refund policies, if applicable, will be stated at the time of enrollment. Course materials are provided for the personal educational use of the enrolled student and may not be reproduced, distributed, or shared without written permission.
Curated External Resources
The Resources section of the Site contains links to third-party websites, tools, public-domain texts, and open-source software. These resources are curated as a service to learners but are not produced, controlled, or endorsed by the Institute. The Institute does not guarantee the accuracy, availability, suitability, or continued existence of any external resource and is not responsible for the content, privacy practices, or terms of use of third-party sites.
Payments and Optional Support
Course payments, subscriptions, purchases, and optional support payments are processed securely through Stripe where available. Optional support is voluntary. Recorded financial activity may appear on the Governance Transparency Dashboard. Supporter identities are never publicly disclosed.
Governance Transparency Dashboard
The Governance Transparency Dashboard provides a public, read-only view of the Institute's financial activity. Data displayed on the dashboard is generated by the Institute's governance engine. The Institute makes reasonable efforts to ensure accuracy but does not warrant that dashboard data is free from error at all times. The dashboard is provided for informational and accountability purposes only and does not constitute a financial statement, audit report, or legal document.
Prohibited Conduct
You agree not to use the Site to distribute spam, malware, phishing attempts, or unauthorized commercial solicitations; attempt to gain unauthorized access to the Institute's systems, servers, or databases; interfere with or disrupt the integrity or performance of the Site; misrepresent your identity, affiliation, or authorization; use automated tools, bots, scrapers, or crawlers to access, copy, or reproduce Site content at scale without written permission; upload or transmit viruses, worms, or other harmful code; or use the Site in any manner that violates any applicable local, state, national, or international law.
Disclaimer of Warranties
THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE INSTITUTE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE INSTITUTE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE INSTITUTE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF THE INSTITUTE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnification
You agree to indemnify, defend, and hold harmless the Institute and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of another.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in the State of Nebraska, and you consent to the personal jurisdiction of such courts.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by the Institute on the Site, constitute the entire agreement between you and the Institute regarding your use of the Site and supersede all prior and contemporaneous agreements, representations, and understandings.
Changes to These Terms
The Institute reserves the right to modify these Terms at any time. Changes take effect upon posting to the Site. The "Last updated" date at the top of this page will be revised accordingly. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
