A. a being over the day,i. e. as law-term,default caused by non-observance of the latest termfor payment,μελλούσης μοι ἤδη ἐξήκειν τῆς ὑ.theterm ofmyborrowing(mystay of execution) being about to expire, D. 47.49 ;ἀναβάλλεσθαι τὴν ὑ.deferit,ib. 50 :—hence,
2. forfeiture of recognizances, distress, εἰληφότες τῇ ὑπερημερίᾳhavingseized itby virtue of this right,
